SKV Law Offices Secures Dismissal of SLP Before Supreme Court in Transmission Line Dispute

Bringing finality to the issue, SKV Law Offices successfully represented T.P. Jalpura Khurja Power Transmission Limited before the Supreme Court of India in a challenge raised by a land owner against laying of overhead transmission lines.

The litigation stemmed from a Special Leave Petition filed by the Petitioner challenging the judgment dated 28.07.2025 of the Hon’ble Allahabad High Court in Second Appeal No. 671/2025, which had affirmed the rejection of his civil suit under Order VII Rule 11 CPC. The legal issue involved was that of Civil Court being approached by a litigant seeking permanent injunction when their exists n alternate remedy under the Telegraph Act. The issue also involved the interplay of Electricity Act, the Telegraph Act and Specific Relief Act surrounding the core issue as to whether the specific bar under the relief act qua stay of an infrastructure project can be interfered through a an alternate remedy sought through clever drafting.

The issue also involved an ex-parte ad interim stay having been granted against T.P. Jalpura Khurja Power Transmission Limited by the Trial Court. SKV team moved swiftly and not only got the stay vacated but also succeeded in getting a favourable order dismissing the civil suit by exercising Order VII Rule 11 CPC route. This dismissal faced multiple challenges through the Regular First Appeal (before the Court of District Judge), Regular Second Appeal (before the Allahabad High Court) and thereafter through a SLP before the Hon’ble Supreme Court. SKV team achieved consecutive success in all Courts. The finality brings in much needed certainty for the project and transmission licensee(s) engaged in setting up of transmission infrastructure.
