SKV Law Offices Secures Interim Relief for TP Jalpura Khurja Power Transmission Limited Before the Allahabad High Court in Right of Way Dispute

SKV Law Offices successfully represented TP Jalpura Khurja Power Transmission Limited before the Hon’ble High Court of Judicature at Allahabad in proceedings concerning obstruction to the construction of a critical intra-State transmission project. By its order dated 16.06.2026, the Hon’ble High Court permitted TP Jalpura to proceed with the installation of the transmission line.

Background

The writ petition was instituted on behalf of TP Jalpura after certain landowners had obstructed TP Jalpura’s overhead stringing work at Village Khairpur Gurjar, Gautam Buddha Nagar, by relying upon an interim order passed in a separate writ proceeding concerning possession of land, hence TP Japura was compelled to invoke the writ jurisdiction of the Hon’ble Allahabad High Court to get a relief.

The Hon’ble High Court after taking note of the fact that TP Jalpura is implementing the 400/220 kV GIS Substation Metro Depot (Greater Noida) and Jalpura Project on a Build, Own, Operate and Transfer (BOOT) basis pursuant to a Transmission Service Agreement executed with Uttar Pradesh Power Transmission Corporation Limited, with the Scheduled Commercial Operation Date fixed for June 2026, passed an order allowing for the installation of Transmission Lines.

Submissions by SKV Law Offices

SKV Law Offices, appearing on behalf of the TP Jalpura, submitted that the ongoing obstruction was legally unsustainable as TP Jalpura was exercising statutory powers for laying an electricity transmission line and was neither acquiring nor taking possession of any land. It was further submitted that the interim order relied upon by the Landowners arose out of separate proceedings concerning land possession and had no application to the TP Jalpura’s statutory right to construct transmission infrastructure under the Electricity Act, 2003 and the Indian Telegraph Act, 1885.

It was further submitted that TP Jalpura had obtained all requisite statutory approvals for implementation of the project, including approval under Section 68 of the Electricity Act, 2003, authorisation under Section 164 of the Electricity Act, 2003, an intra-State transmission licence granted by the Uttar Pradesh Electricity Regulatory Commission, and the necessary No Objection Certificate from the Greater Noida Industrial Development Authority.

SKV Law Offices also emphasised the time-bound nature of the project and submitted that any delay would jeopardise achievement of the Scheduled Commercial Operation Date, thereby adversely affecting the implementation of an important public utility transmission project.

Decision of the Hon’ble Court

Accepting TP Jalpura’s request for interim relief, the Hon’ble High Court permitted TP Jalpura to proceed with the installation of the transmission line.

Significance

The order ensures that implementation of a critical electricity transmission project is not stalled on account of objections founded upon proceedings unrelated to the TP Jalpura’s statutory right of way.
